1. Agreement & Scope

Welcome to Holiday Harbour Marina (“HHM”, “we”, “our”, “us”). These Terms & Conditions (“Terms”) apply to your access to and use of holidayharbourmarina.com (the “Site”) and to purchases made through the Site. By visiting the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

We sell curated, verified apparel including BAPE shirts and related streetwear. Availability may be limited and subject to change at any time.

2. Eligibility & Accounts

  • You must be at least the age of majority in your jurisdiction to purchase. If you are under the age of majority, you may only use the Site with involvement of a parent or guardian.
  • When you create an account, you are responsible for maintaining the confidentiality of your login and for all activities under your account. Notify us promptly of any unauthorized use.
  • We may refuse service, terminate accounts, or cancel orders where we reasonably suspect fraud, abuse, or violation of these Terms.

3. Orders & Payments

  • Placing an item in cart does not reserve it. Your order is accepted only when we send an order confirmation email.
  • We accept major payment methods shown at checkout, including Mastercard, Visa, and PayPal. By submitting a payment, you represent that you are authorized to use that method.
  • We may cancel or limit quantities per customer, per household, or per order. If we cancel, we will refund the original payment method.
  • Preorders or restocks will include estimated timelines, which are subject to change. We will keep you informed if timelines shift.

4. Pricing, Taxes & Duties

  • Prices are listed in USD unless noted. We reserve the right to change prices at any time before acceptance of your order.
  • Applicable sales taxes are calculated at checkout based on your shipping address.
  • International shipments may incur customs duties, VAT, or import fees, which are the responsibility of the recipient unless otherwise stated at checkout.

5. Shipping & Delivery

  • We ship worldwide from Chicago, IL. Options and carriers are displayed during checkout.
  • Processing time is typically 1–2 business days. Transit times vary by destination and carrier.
  • Once shipped, risk of loss passes to you. If a package is marked delivered but cannot be found, please first check with your household and neighbors, then contact the carrier. We will assist where possible.
  • Please ensure your shipping address is correct; we are not responsible for delays or losses due to incorrect addresses provided at checkout.

6. Returns & Refunds

  • We offer a straightforward inspection and returns process. Items must be in original condition with tags (if applicable) and not worn, washed, or altered.
  • Initiate a return within the published window on the product page or policy page. Once received, we typically inspect within two business days.
  • Refunds post to your original payment method. Shipping fees may be non-refundable unless the return is due to our error.
  • Exchanges are subject to availability. If an exchange cannot be completed, we will issue a refund.

7. Authenticity & Product Info

  • Every tee undergoes a multi-point verification including provenance, stitch quality, tag fonts, lot codes, and graphic fidelity under calibrated lighting.
  • Measurements are provided on product pages. Streetwear fits can vary by release; consider sizing up for a looser drape.
  • We photograph at 5600K and include natural-light angles to represent color as accurately as possible. Screens and ambient light may shift perception.
  • Minor variances can occur in color or pattern placement, particularly with camo or special graphics.

8. Promotions, Discount Codes & Gift Cards

  • Promotions are limited-time and may not be combined unless explicitly stated.
  • Discounts apply pre-tax and pre-shipping. Non-transferable and not redeemable for cash.
  • Gift cards are final sale, non-refundable, and do not expire where prohibited by law.

9. Reviews & User Content

  • By submitting reviews, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Site and our marketing, subject to our Privacy Policy.
  • We may moderate, edit, or remove content that is unlawful, infringing, misleading, defamatory, or otherwise violates these Terms.

10. Intellectual Property

  • The Site, including text, graphics, logos, and layout, is owned by Holiday Harbour Marina or used under license and is protected by applicable IP laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
  • “BAPE” and “A BATHING APE” are trademarks of their respective owners. Holiday Harbour Marina is not affiliated with, endorsed by, or an official retailer of A BATHING APE. Any references are for descriptive purposes to identify products lawfully offered for sale.

11. Acceptable Use

  • Do not engage in scraping, automated access, or attempts to bypass technical measures.
  • Do not upload or transmit malware, spam, or content that infringes rights of others.
  • Use the Site only for lawful purposes and in accordance with these Terms.

12. Warranties & Liability

  • Except as expressly stated, the Site and products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim related to your purchase will not exceed the amount you paid for the applicable product.
  • Some jurisdictions do not allow limitations on implied warranties or exclusions of damages; these limitations may not apply to you.

13. Governing Law & Disputes

  • These Terms are governed by the laws of the State of Illinois and the United States, without regard to conflict of law principles.
  • Dispute Resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at [email protected]. If not resolved within 30 days, either party may pursue permitted remedies. Where allowed by law, you agree to resolve claims individually; class actions and jury trials are waived.
  • Consumers in jurisdictions with mandatory local protections retain any non-waivable consumer rights under local law.

We may update these Terms from time to time. Material changes will be noted by updating the effective date above and, where appropriate, by additional notice. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
